Analisis Penegakan Hukum dan Pertanggungjawaban Kode Etik Profesi Polri Atas Penyalahgunaan Wewenang oleh Aparat Brimob dalam Kasus Penganiayaan terhadap Pelajar Madrasah Tsanawiyah di Tual Maluku

Abstract

The purpose of this study is to investigate ethical responsibility and law enforcement in the Indonesian National Police. (Polri) concerning the abuse of authority by Brimob personnel in a case involving the assault of a Madrasah Tsanawiyah student in Tual, Maluku. The incident reflects a deviation in the execution of police duties, which should uphold professionalism, proportionality, and respect for human freedoms. It's research e uses a normative legal approach that makes use of statutory,legal principles, doctrinal, jurisprudential, and case methods. The findings indicate that law enforcement against violations committed by police officers is not limited to criminal liability but also encompasses enforcement of the professional code of ethics as a form of internal institutional oversight. Ethical accountability plays a crucial role in preserving the police institution's integrity and rebuilding public confidence.However, in practice, several challenges remain, including a lack of transparency and inconsistency in the imposition of sanctions. Therefore, strengthening oversight mechanisms and enforcing more firm and accountable legal measures are necessary to prevent future abuse of authority by law enforcement officials.
