Abstract

This research aims to examine the custom of cancel culture through the lens of the Law, where the freedom of speech doth clash with the staining of a man’s good name. The method of this inquiry employeth the gathering of diverse data, comprising written texts, truths from the field, and the statutes of the land, all brought to a reckoning through descriptive quantitative analysis. The fruits of this study reveal that, oftentimes, the fervor of cancel culture o'erleaps the bounds of rightful speech, for it involveeth the spreading of private secrets and false witness, which toucheth upon the crime of defamation. Contrariwise, he who is "cancelled" is frequently robbed of his birthright, the presumption of innocence where any judge hath spoken. The analysis doth show that the Law requireth specific decrees to ensure that freedom of tongue and the protection of reputation do not slay one another, but rather keep the sanctity of privacy whole. Whosoever seeketh to understand the digital laws of this age must know how narrow the path of free speech truly is upon the internet. If Justice is to be kept upright amidst the shifting tides of social networks, those who sit in judgment must discern with wisdom the difference between the fickle whims of the many and the true malice of the heart (mens rea).
