Abstract

Corruption in the distribution of social assistance is a form of crime that has a significant impact on state finances and public welfare, particularly affecting vulnerable groups who should receive assistance in a targeted and appropriate manner. The main problems in such practices are generally related to weak transparency and accountability in the processes of data collection, beneficiary determination, and aid distribution. These conditions create opportunities for abuse of authority, data manipulation, deduction of aid funds, and even budget embezzlement by certain parties. This study aims to examine, from a legal perspective, various forms of lack of transparency in the distribution of social assistance and to analyze the application of legal provisions under Indonesia’s Anti-Corruption Law. This research employs a normative legal method using a statutory approach and a case approach. Data were obtained through a literature review encompassing laws and regulations, court decisions, scientific journals, and other relevant legal literature. The results of the study indicate that unlawful misuse of social assistance that causes losses to state finances may be categorized as a corruption offense as stipulated in Articles 2, 3, and 12 of Law Number 31 of 1999 in conjunction with Law Number 20 of 2001. The COVID-19 social assistance corruption case involving Juliari Batubara demonstrates that weak oversight and a lack of transparency can lead to abuse of authority in the management of social assistance. Therefore, it is necessary to strengthen oversight systems, increase transparency, digitalize social assistance data, and enforce the law firmly in order to prevent and eradicate corruption in the distribution of social assistance in Indonesia.
